GENERAL TERMS AND CONDITIONS OF SALE

1. Scope of Application

These terms and conditions apply to all purchases made through our online store, both by consumers and commercial buyers, including physical products, digital services, and gift cards.

By making a purchase, the customer declares that they have read, understood, and accepted these terms and conditions in full.

2. Nature of the Commercial Relationship

ViProSports acts as an authorized intermediary and commercial coordinator between the international supplier and the final consumer, without assuming the legal status of direct importer before the customs authorities of the transit or destination country.

International dispatch may be managed directly by the foreign supplier or manufacturer, while ViProSports handles logistics coordination, tracking, and after-sales customer support.

The customer acknowledges that international operations may be subject to transport policies, customs inspections, and the laws of the countries of origin, transit, or destination. Therefore, ViProSports shall not be held liable for matters beyond its intermediary role, nor for actions or decisions attributable to third-party carriers or customs agents.

3. Prices, Taxes, and Duties

All prices displayed in the store are final and include estimated taxes, customs duties, and import charges.

However, under international trade regulations, the customer accepts the following:

  • If a tariff or tax modification takes effect after the purchase is completed, ViProSports may adjust or request an additional payment to cover the actual increase in import or nationalization costs.
  • If the customer does not accept such adjustment, they may request cancellation of the order and a corresponding partial refund, minus administrative and logistical expenses already incurred.
  • ViProSports shall not be held responsible for retroactive tariff increases, seizures, or shipment blockages resulting from governmental or unforeseen international policy decisions.

ViProSports will make every reasonable effort to mitigate the effects of any tariff increase, always seeking the most favorable alternative for the customer.

4. Cancellations and Returns

Cancellations

  • Due to force majeure or already dispatched shipment: A 20% administrative fee will be retained if the cancellation occurs within the estimated delivery period.
  • Due to lack of stock: A full refund (100%) will be issued if the product is unavailable.

Returns

  • Timeframe: 7 business days after receiving the order.
  • Conditions: The product must be unused, in its original packaging, and with intact labels. A 20% administrative fee will apply.
  • Process: Refunds will be processed within a maximum period of 30 calendar days after the product has been verified.
    In no case shall the total time for returning the funds exceed 30 calendar days from the date of refund approval confirmation by ViProSports.

Exceptions apply to defective products or those covered by an active warranty.

5. Refund Policy and Contract Status

ViProSports has no control over, nor responsibility for, the logistical or customs processes managed by independent international carriers or agents (such as UPS, DHL, or FedEx). The international transit condition includes the period during which the merchandise is held or under review in the warehouses of these carriers.

No full refund shall be issued while the merchandise is in international transit or undergoing customs clearance. While the merchandise remains under the control of customs authorities, international carriers, or third-party logistics providers, the contract shall be considered active, and ViProSports shall not be deemed in breach.

ViProSports shall not be liable for delays arising from external causes, including but not limited to:

  • Customs holds or security inspections.
  • Misclassification by international carriers (e.g., UPS, DHL, FedEx).
  • Unforeseen regulatory or tariff changes in transit countries.
  • Force majeure events or international policy restrictions.

6. Memberships and Benefits

  • By purchasing a membership, the customer accepts these terms and our Privacy Policy.
  • ViProSports may modify or discontinue benefits without prior notice.
  • Memberships are non-refundable and constitute a direct form of brand support.

7. Personal Data Processing

  • Personal data is processed in accordance with international data protection standards (GDPR and equivalent regulations).
  • The customer may request correction or deletion of their data by contacting info@viprosports.net.
  • By making a purchase, the customer authorizes the use of their data for logistical, commercial, and after-sales purposes.
  • iProSports does not sell or share personal data with third parties, except when legally required or for logistical reasons directly related to the order.

8. Delivery Times and Force Majeure

Delivery times are estimated and may vary due to transportation conditions, international regulations, or unforeseen events.

The customer acknowledges that delivery times do not constitute a binding contractual guarantee and that justified delays shall not be considered a breach by ViProSports.

Force majeure events include, but are not limited to, customs restrictions, sudden changes in import regulations, new tariff impositions, economic sanctions, or any governmental decision affecting international logistics. Such circumstances shall be deemed force majeure or fortuitous events under international trade law.

9. Express Acceptance Prior to Payment

Before completing the purchase, the customer must confirm:

“I declare that I have read and accept the terms and conditions of this online store, including international shipping terms, possible tariff variations, and delivery conditions established by ViProSports.”

10. Governing Law and Jurisdiction

This agreement is governed by the international principles of e-commerce and by the legislation of the legal domicile of ViProSports. In the event of interpretive conflict, the Spanish version shall prevail.

  • Business Clients (B2B): Disputes shall be resolved through international commercial arbitration under the rules of the International Chamber of Commerce (ICC).
  • Consumer Clients (B2C): Consumers may initiate proceedings in their country of residence or in the seller’s jurisdiction, in accordance with local consumer protection laws.

In case of jurisdictional conflict, the inalienable rights of the consumer shall prevail.

11. Modifications

ViProSports reserves the right to modify these terms at any time. Updated versions will be published on the website and will apply only to future purchases.
