1. Scope of Application

1.1 These General Terms and Conditions (hereinafter, "Terms") of ViProSports (hereinafter, "Seller") apply to all contracts entered into between a consumer or merchant (hereinafter, "Customer") and the Seller, related to the goods and/or services presented on the Seller's online store.

1.2 These Terms also apply to the purchase of vouchers, unless expressly agreed otherwise.

1.3 A "consumer" in these Terms is a natural person who enters into a legal transaction for purposes not primarily related to a commercial or independent professional activity.

1.4 A "merchant" is a natural or legal person, or a corporation with legal capacity, acting in the exercise of its commercial or independent professional activity when entering into a legal transaction.

2. Purchases

2.1. Delivery times (approximate)

  • 2-4 weeks (USA)

  • 4-6 weeks (South America)

Please note that factors outside our control, such as customs transit or importation management of the packages, may delay delivery times. If additional documentation is required to complete customs procedures, there may be unforeseen delays. However, we will do everything possible to expedite the process so you can receive your products as quickly as possible. If you agree to these terms, proceed with your purchase.

2.2. Exceptions to Delivery Times
We are not responsible for delays caused by circumstances beyond our control, such as pandemics, national strikes, war, strikes affecting transportation of goods, last-minute changes by suppliers, or additional customs procedures that affect estimated delivery times.

2.3. Local Shipments
Delivery to your address depends on the coverage of the shipping company. If your location is not covered, you will need to pick up your purchase at the nearest office of the shipping company.

3. Order Cancellation

3.1. Right of Withdrawal
In accordance with Article 47 of the Consumer Protection Law (Law 1480 of 2011), the consumer has the right to withdraw from their purchase within five (5) business days after receiving the product, without the need to justify the decision. To exercise this right, you must contact us via email at info@viprosports.net within the stated period.

In this case, the product must be in its original condition, with no signs of use, and with its original packaging. The refund will be made within 30 calendar days following the withdrawal request.

3.2. Cancellation Due to Force Majeure
If, due to force majeure and within the agreed delivery times, you decide to cancel your order, a 20% fee of the final product price will be charged for management. The remaining 80% will be refunded within a maximum of 30 calendar days. In cases where our suppliers run out of stock without notifying us, we will refund 100% of the purchase within 30 calendar days.

3.3. Cancellation After Receiving the Order
If you decide to cancel your order after receiving it, a 20% fee for management will be charged, and the remaining 80% of the purchase price will be refunded within 30 calendar days. To proceed with the cancellation, you must send a request to info@viprosports.net within 8 business days after receiving the product. It is important that the product shows no signs of use and retains its original packaging.

4. Membership

4.1. Acceptance of Terms and Privacy Policy
By clicking on "buy a membership" and using our platform, you declare that you have read, understood, and accepted our Privacy Policy, as well as these Terms and Conditions. ViProSports may review the Privacy Policy at any time, and the new versions will be published on the site. If at any time you disagree with any part of the Privacy Policy, you must stop using the site and the service immediately.

4.2. Discount Platform for Members
ViProSports offers exclusive discounts for members across our entire product catalog. We reserve the right to add, change, modify, suspend, or discontinue any part of our services at our sole discretion, at any time. The use of the site and/or services, including the availability of new services through the site, will be subject to these terms and conditions.

4.3. Restrictions and Modifications to Services
ViProSports may impose limits on any part of the service or restrict access to parts or all of the site at its sole discretion, without prior notice or liability.

4.4. Non-Refundability of Memberships and Promotional Packages
When purchasing a membership or a unique package on our platform, you are supporting the ViProSports brand. It is important to note that memberships and unique packages purchased during a promotional period or a giveaway are non-refundable. Our goods and services come with warranties that cannot be excluded by law.

5. Prices and Payment Conditions

5.1. Prices
The prices listed for the products are the total prices, unless otherwise stated in the product description, and will be subject to Colombian law. Products will be subject to VAT in accordance with the applicable tax regulations in Colombia.

5.2. Payment Methods
Payment can be made using one of the payment methods mentioned on the Seller's online store.

5.3. Additional Costs
If the Customer makes the payment from outside Colombia, additional costs such as bank fees, import taxes, or customs duties may apply, which are not the responsibility of the Seller.

6. Privacy Policy

6.1. Processing of Personal Data
In accordance with Law 1581 of 2012 (Personal Data Protection), ViProSports Latin America SAS will process your personal data for the purpose of managing and processing your order, as well as for other commercial purposes related to our products and services.

6.2. Rights of the Data Subject
As the data subject, you have the right to access, rectify, cancel, or oppose the processing of your personal data in accordance with the law. If you wish to exercise any of these rights, you can contact us via email at info@viprosports.net.

6.3. Consent
By making a purchase on our site, you consent to the processing of your personal data in accordance with our privacy policy. You can revoke your consent at any time by notifying us through the email mentioned above.

7. Applicable Law

7.1. Applicable Law
The law applicable to all legal relationships between the parties will be Colombian law, excluding the legislation on international sale of movable goods.

7.2. Exception for Consumers
If the Customer is a consumer, this choice of law will only apply insofar as it does not contravene the mandatory legal provisions of the Customer's country of residence.

8. Jurisdiction

8.1. Jurisdiction for Merchants
In case of a dispute, if the Customer is a merchant, the jurisdiction will be the Seller's place of residence or the Seller's registered office, as applicable.

8.2. International Jurisdiction
If the Customer is domiciled outside Colombia, the Seller may choose to file the case in the court of the Customer's jurisdiction or the competent court of the Seller's domicile.

9. Alternative Dispute Resolution

9.1. Dispute Resolution for Consumers
In Colombia, consumers have the right to file complaints or claims before the Superintendence of Industry and Commerce (SIC), in accordance with current regulations.

9.2. Participation in Dispute Resolution
The Seller is not obliged to participate in an alternative dispute resolution process.

10. Modifications to the Terms and Conditions

ViProSports reserves the right to modify these terms and conditions at any time. Modifications will take effect once published on the site and will apply to purchases made after such publication.
